I was injured by a product. What are the things I need to do?

People can be injured by products they use every day. For example, a chair collapses underneath you and you are injured, or you use a swimming pool slide and are injured. In those cases, the first thing to do is assure that you have been properly treated at the Hospital or by your Doctor. While you are making sure there is proper medical treatment, though, ask someone else to try and get the following information:

  • The name of the company that made the product
  • Pictures of the product, or the product itself if it is portable
  • The name of the company that sold the product to the owner
  • The name of the company that had the product available for you to use (e.g. a hotel, a store, etc.)
  • Pictures of any labels on the product, particularly those that contain warnings or other information
  • The owner’s manual for the product
  • Any report made about the injury (e.g. to a hotel or a store, or to the police if they attend)

These items will give your lawyer a starting point for his or her investigation into your product liability case, to see whether there is:

  • a defect in the product itself which caused your injury or
  • something about the design of the product which caused your injury.

Product liability claims can be made in contract or in negligence. These types of lawsuits, like professional negligence lawsuits , need a lot of work at the beginning of the case, to establish what feature of the product caused the problem.
